Trump has a history of <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2017\/jan\/18\/donald-trump-media-manipulation-tactics\"><span style=\"font-weight: 400\">manipulating the media<\/span><\/a><span style=\"font-weight: 400\">, blaming the press for <\/span><a href=\"http:\/\/www.politico.com\/blogs\/on-media\/2017\/01\/trump-refusing-to-answer-question-from-cnn-reporter-you-are-fake-news-233485\"><span style=\"font-weight: 400\">publishing fake news<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.washingtonpost.com\/lifestyle\/style\/trump-revokes-post-press-credentials-calling-the-paper-dishonest-and-phony\/2016\/06\/13\/f9a61a72-31aa-11e6-95c0-2a6873031302_story.html?utm_term=.0563d01b0b3a\"><span style=\"font-weight: 400\">banning reporters from his events<\/span><\/a><span style=\"font-weight: 400\">. He has caused concern among journalists about what he might change once he officially takes control of the White House. Though the future is uncertain, here are a few things Trump won\u2019t be able to change about the press:<\/span><\/p>\n<p><b>THE FIRST AMENDMENT<\/b><\/p>\n<p><span style=\"font-weight: 400\">The <\/span><a href=\"https:\/\/constitutioncenter.org\/interactive-constitution\/amendments\/amendment-i\/the-freedom-of-speech-and-of-the-press-clause\/interp\/33\"><span style=\"font-weight: 400\">First Amendment<\/span><\/a><span style=\"font-weight: 400\"> protects the rights of free speech and free press (and also religion, assembly and petition). And given that this is highly unlikely to ever be repealed, the press will have the right to report on what the government is doing. This includes federal, state and local governments, which was made clear in <\/span><a href=\"https:\/\/www.oyez.org\/cases\/1900-1940\/268us652\"><span style=\"font-weight: 400\">Gitlow v. New York<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><b>SUPREME COURT RULINGS<\/b><\/p>\n<p><span style=\"font-weight: 400\">The Supreme Court has sided with journalists a number of times when it came to cases against the government. In some of the most notable cases, the Supreme Court ruled that prior restraint is unconstitutional, unless a newspaper shows \u201creckless disregard for the truth,\u201d it is protected under the First Amendment and gag orders violate First Amendment Rights. Check out more cases <\/span><a href=\"http:\/\/money.howstuffworks.com\/10-supreme-court-cases-journalists.htm\"><span style=\"font-weight: 400\">here<\/span><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"https:\/\/billofrightsinstitute.org\/educate\/educator-resources\/landmark-cases\/freedom-of-the-press\/\"><span style=\"font-weight: 400\">here<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"http:\/\/www.ala.org\/advocacy\/intfreedom\/censorshipfirstamendmentissues\/courtcases\"><span style=\"font-weight: 400\">here<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><b>SYSTEM OF CHECKS AND BALANCES<\/b><\/p>\n<p><span style=\"font-weight: 400\">Remember when you learned about the government\u2019s system of checks and balances? The executive branch (the president) does not have complete power. It is balanced by the legislative branch (House and Senate) and judicial branch (Supreme Court). So in order for Trump to pass any legislation restricting the press, he would need to get it passed in both the House and Senate. If this were to happen, that law could then be challenged at the Supreme Court, which, as seen above, has protected a lot of the press\u2019s rights.<\/span><\/p>\n<p><b>ORGANIZATIONS THAT HELP PROTECT RIGHTS<\/b><\/p>\n<p><span style=\"font-weight: 400\">Should you come up against a legal suit, there are a number of organizations willing to help you, sometimes pro bono (for free). Contact any of the following organizations should you find yourself in a legal bind.<\/span><\/p>\n<p><a href=\"https:\/\/www.aclu.org\/know-your-rights?topics=149\"><span style=\"font-weight: 400\">American Civil Liberties Union (ACLU)<\/span><\/a><span style=\"font-weight: 400\"> \u2014 The ACLU\u2019s mission is to \u201cdefend and preserve the individual rights and liberties guaranteed by the Constitution and laws of the United States.\u201d<\/span><\/p>\n<p><a href=\"http:\/\/www.splc.org\/\"><span style=\"font-weight: 400\">Student Press Law Center (SPLC)<\/span><\/a><span style=\"font-weight: 400\"> \u2014 The SPLC offers legal advice to students. It works to provide information regarding what rights students have (which became limited after Hazelwood v. Kuhlmeier) and give pro bono legal assistance if needed.<\/span><\/p>\n<p><a href=\"http:\/\/rcfp.org\/about\"><span style=\"font-weight: 400\">Reporters Committee for Freedom of the Press<\/span><\/a><span style=\"font-weight: 400\"> \u2014 This organization provides free legal resources, support, and advocacy to protect the First Amendment and freedom of information rights of journalists working in areas where U.S. law applies, regardless of the medium in which their work appears.<\/span><\/p>\n<p><a href=\"http:\/\/www.omln.org\/\"><span style=\"font-weight: 400\">Online Media Legal Network (OMLN)<\/span><\/a><span style=\"font-weight: 400\"> \u2014 OMLN is willing to \u201cprovide pro bono (free) and reduced fee legal assistance to qualifying online journalism ventures and other digital media creators.\u201d<\/span><\/p>\n<p><a href=\"https:\/\/www.eff.org\/pages\/legal-assistance\"><span style=\"font-weight: 400\">Electronic Frontier Foundation (EFF)<\/span><\/a><span style=\"font-weight: 400\"> \u2014 EFF works to \u201censure that the civil liberties guaranteed in the Constitution and the Bill of Rights are applied to cutting edge communication technologies.\u201d<\/span><\/p>\n<p><a href=\"https:\/\/www.spj.org\/ldf.asp\"><span style=\"font-weight: 400\">Society of Professional Journalists\u2019 Legal Defense Fund<\/span><\/a><span style=\"font-weight: 400\"> \u2014 This fund provided by SPJ serves to provide \u201cjournalists with legal or direct financial assistance.\u201d<\/span><\/p>\n<p><a href=\"http:\/\/www.nfoic.org\/knight-foi-fund\"><span style=\"font-weight: 400\">National Freedom of Information Coalition\u2019s Knight FOI Fund<\/span><\/a><span style=\"font-weight: 400\"> \u2014 The NFOIC\u2019s Knight FOI Fund \u201cexists to offer financial support in open government lawsuits. It was established to fuel and assist the pursuit of important FOI cases by helping to defray upfront costs such as filing fees, depositions, court costs and other expenses associated with legal actions.\u201d<\/span><\/p>\n<p><a href=\"http:\/\/ccrjustice.org\/home\/what-we-do\"><span style=\"font-weight: 400\">Center for Constitutional Rights<\/span><\/a><span style=\"font-weight: 400\"> \u2014 \u201cThe Center for Constitutional Rights is dedicated to advancing and protecting the rights guaranteed by the United States Constitution and the Universal Declaration of Human Rights.\u201d<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>With the inauguration of President-elect Donald Trump today, many in the media are wondering what it means for them.
