{"id":4030,"date":"2024-03-22T09:12:44","date_gmt":"2024-03-22T13:12:44","guid":{"rendered":"https:\/\/blogs.bsu.edu\/doma\/?p=4030"},"modified":"2026-01-27T15:42:39","modified_gmt":"2026-01-27T20:42:39","slug":"what-is-nagpra","status":"publish","type":"post","link":"https:\/\/blogs.bsu.edu\/doma\/2024\/03\/22\/what-is-nagpra\/","title":{"rendered":"What is NAGPRA?"},"content":{"rendered":"\n<p><em>Written by Tori Smith, Public Relations and Social Media Assistant<\/em><\/p>\n\n\n\n<p>When visitors come into the museum, they might find themselves venturing off into the Africa, Americas, and Pacific Islands galleries only to be met by something unexpected: covered displays.<s>&nbsp;<\/s>&nbsp;&nbsp;<\/p>\n\n\n\n<p>The displays are covered up for reasons related to<a href=\"https:\/\/www.nps.gov\/subjects\/nagpra\/index.htm\" target=\"_blank\" rel=\"noreferrer noopener\"> NAGPRA<\/a>: the Native American Graves Protection and Repatriation Act. This federal law has been in place since 1990 and provides for the protection and possible return of Native American:&nbsp;&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"1\">\n<li>Human remains (DOMA does not collect human remains)&nbsp;&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li>Funerary objects&nbsp;&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\">\n<li>Sacred objects&nbsp;&nbsp;<\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"4\">\n<li>Objects of cultural patrimony&nbsp;&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>NAGPRA requires federal agencies and institutions who receive federal funds to consult with Native American Nations to repatriate certain belongings and remains to their descendants, as well as improve the care and storytelling of the belongings left in museums.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Recent updates to NAGPRA\u2019s regulations <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/12\/13\/2023-27040\/native-american-graves-protection-and-repatriation-act-systematic-processes-for-disposition-or\" target=\"_blank\" rel=\"noreferrer noopener\">went into effect on January 12, 2024<\/a>. The regulations update definitions and procedures for museums and Federal agencies regarding their compliance with NAGPRA regulations, including new requirements on museums obtaining consent from culturally-affiliated Native American Nations prior to any public display of certain cultural objects. DOMA has covered its display cases while it consults with Native American Nations regarding these objects.
